Separate incidents occur in early morning of Friday, March 28
On Friday, March 28, at 12:58 a.m., a New Garden Township officer observed a Toyota being driven erratically in the 9100 block of Gap Newport Pike, crossing the center double line several times, police said. A traffic stop was conducted in the 8700 block of Gap Newport Pike, and contact was made with the driver, Newell Everett, 55 of New Holland, police said.
Everett, who had glassy eyes and a strong odor of alcohol, admitted that he had been drinking and said he knew he had crossed the center lines, police said. Field sobriety tests and a portable breath test revealed further signs of alcohol impairment, police said. Everett was taken into custody for suspicion of DUI, and after being processed, he was released pending an appearance in district court, police said.
On Friday, March 28, at 2:16 a.m., a New Garden Township officer on patrol in the area of West Baltimore Pike and Scarlett Road observed a vehicle approaching from behind that failed to dim its headlights, police said. The vehicle passed the officer at a high rate of speed and continued at speeds in excess of the 45 mph limit, police said, leading to a traffic stop at West Baltimore Pike and Buena Vista Drive.
Upon approach to the vehicle, the driver and sole occupant of the vehicle, Francisco Zavala-Cortes, 22, of Kennett Square, was not wearing a seatbelt and smelled of alcohol, police said. Zavala-Cortes, who admitted that he had had a “couple drinks,” was taken into custody for suspicion of DUI after showing signs of impairment during field sobriety tests, police said. After being processed, Zavala-Cortes was released pending an appearance in district court, police said.
On Friday, March 28, at 10:48 p.m., a New Garden Township police officer received a walk-in report of a domestic incident that occurred in the 900 block of Newark Road, police said. The victim said that her husband asked her for money and when she refused, he threatened to kill her, police said. After her small children began to cry, she handed her husband $40, and when her husband left the room, she took the children and fled from the house, police said. The husband, Jose Morales, 42, of Toughkenamon, followed and screamed for the victim to open the car door while pulling on the handle; it broke and the victim drove away without any further incident, police said.
A warrant was obtained for Morales on charges of terroristic threats and harassment, and he was taken into custody the following morning, police said. He was arraigned and remanded to Chester County Prison after failing to post $15,000 bail, police said.
