New Garden Police say incidents happened in span of three days
On Thursday, May 1, 1:19 a.m., the New Garden Police Department responded to the 300 block of Scarlett Road for a report of a male refusing to leave a business, police said. Upon arrival, officers contacted Modesto Bernal, 51, of Kennett Square, observed lying prone in front of the store, police said. Bernal exhibited signs of intoxication and was transported from the scene by ambulance for an injury unrelated to the call for service, police said. A summons for public drunkenness was filed against Bernal, police said.
Three days later, on Sunday, May 4, at 8:44 a.m., New Garden officers responded to the 300 block of Scarlett Road for a subject refusing to the leave a business. Police said they made contact with Bernal again; this time he was sitting in lawn chairs that were for sale. He was ordered to leave the premises and not to return, and a summons for trespass was filed, police said. Bernal was cited for similar behavior in the same location on April 6, court records said.
On Saturday, May 3, at 1:43 a.m., New Garden Township officers observed a vehicle driving erratically in the 900 block of Newark Road, police said. The vehicle was observed driving approximately 50 feet northbound in the southbound lanes before drifting onto the shoulder and almost striking the road bank, police said. A traffic stop was conducted, and contact made with the driver, Robert Grove, 56 of Coatesville, police said. A strong odor of an alcoholic beverage was detected, and Grove, who had an open can of beer on the driver’s side of the vehicle, was observed to have bloodshot eyes and slurred speech and failed field sobriety tests, police said. Grove was taken into custody for suspected DUI and released pending an appearance in district court, police said.
