The first chapter to close in the Coatesville Area School District’s texting/fund diversion scandal came Monday when former Coatesville Area High School Athletic Director James Donato pleaded guilty to charges of diverting district funds and violating the state ethics law and agreed to make some $15,000 in restitution to the school district.
Appearing before Senior Judge Thomas Galvin, Donato entered his plea of guilty to charges of theft and violation of the state ethics law. He faces sentencing on Aug. 12 and still will be liable for civil litigation by the school district.
Donato, who also was head football coach at Kennett High School before moving to Coatesville as Athletic Director, was at the center of a texting scandal, wherein he exchanged racially charged texts with former Superintendent Richard Como. The ensuing investigation turned up questionable financial behaviors by both, leading to criminal charges.
Donato’s charges stemmed from allegations that he diverted athletic gate receipts to himself, rather than turning them over to the district when he served as athletic director from 2009 to 2013. He was also charged with running off-book events at the school’s campus and pocketing the proceeds.
Through his attorney Daniel Bush of Lamb McErlane, Donato expressed sorrow for his actions:
“Mr. Donato apologizes to the people of the Coatesville Area School District. They are the ones affected by this, as were the students by the numerous good acts in which Mr. Donato engaged. Mr. Donato pleaded guilty to a series of small dollar amount acts which, over the course of his four year tenure, totaled to $15,000.00. He has re-paid that amount. Hopefully, his acceptance of responsibility closes the door on this piece of history for all parties involved.”
Como will face trial later this year.
