{"id":27369,"date":"2018-02-05T14:56:27","date_gmt":"2018-02-05T19:56:27","guid":{"rendered":"http:\/\/kennetttimes.com\/?p=27369"},"modified":"2018-02-05T14:56:31","modified_gmt":"2018-02-05T19:56:31","slug":"its-on-u-s-supreme-court-paves-way-for-congressional-redistricting","status":"publish","type":"post","link":"https:\/\/kennetttimes.com\/?p=27369","title":{"rendered":"It&#8217;s on: U.S. Supreme court paves way for Congressional redistricting"},"content":{"rendered":"<div id=\"attachment_6381\" style=\"width: 333px\" class=\"wp-caption alignright\"><a href=\"http:\/\/kennetttimes.com\/wp-content\/uploads\/2018\/02\/PA7.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-6381\" class=\"size-medium wp-image-6381\" src=\"http:\/\/kennetttimes.com\/wp-content\/uploads\/2018\/02\/PA7-323x300.jpg\" alt=\"\" width=\"323\" height=\"300\" \/><\/a><p id=\"caption-attachment-6381\" class=\"wp-caption-text\">The 7th District as we knew it is no more, following Monday&#8217;s decision by the U.S. Supreme Court not to consider a stay to a state Supreme Court ruling that said the state&#8217;s Congressional district violated the state Constitution.<\/p><\/div>\n<p class=\"p1\"><span class=\"s1\"><strong>By Mike McGann<\/strong>, <\/span><span class=\"s1\"><em>Editor, The Times<\/em><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Nah, nah, nah, \u2014 nah, nah, nah \u2014 heeeeeey, goodbye.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">No, we\u2019re not talking about the Patriots\u2019 hopes for a Super Bowl win over the mighty Philadelphia Eagles, but rather the future of the 7th Congressional District, a district that cuts through the middle of Chester County and is widely seen as the single-most Gerrymandered Congressional district in the entire United States.<\/span><!--more--><\/p>\n<p class=\"p1\"><span class=\"s1\">The map had been ruled unconstitutional \u2014 under the state constitution \u2014 by the Pennsylvania Supreme Court, which ordered the state legislature to draw up new maps by this week and submit them to Gov. Tom Wolf and get his sign off \u2014 and if they failed, the court would appoint a special master to draw up new district boundaries. But Republicans balked \u2014 refusing to supply the court with municipal and precinct information and seeking a stay of the ruling from the federal courts.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Monday, U.S. Supreme Court Samuel Alito, who oversees the Third Federal District, declined to take up an appeal for a stay of by Pennsylvania Republicans \u2014 meaning that the state court ruling will stand and the legislature has just days to come up with a new map. Whether state Senate Republicans will face criminal contempt charges from the state Supreme Court for failing to follow its order remains to be seen.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Wolf, in a statement, applauded the U.S. Supreme Court\u2019s decision not to take up the case.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThe U.S. Supreme Court correctly recognized that there is no reason to delay implementing the Pennsylvania Supreme Court\u2019s order,\u201d Wolf said.\u00a0\u201cNow, all parties\u00a0must focus on getting a fair map in place. Gerrymandering is wrong and we must correct errors of the past with the existing map. My team is ready, willing and able to work with the General Assembly to ensure a new map is fair and within the clear orders given by the Pennsylvania Supreme Court.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">This throws the entire local Congressional map in the air \u2014 it is likely that all three Chester County districts \u2014 the 7th, 6th and 16th \u2014 will be changed a great deal and some candidates for those seats may find themselves no longer living in the district they planned to seek office in. It also will make the 6th and 7th \u2014 both \u201ctweaked\u201d in 2011 by the state legislature to make them more Republican friendly \u2014 much more likely battleground districts.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">It was that tweaking \u2014 Gerrymandering \u2014 that may have violated the state Constitution by failing to create \u201ccompact\u201d districts as specifically required. The meandering 7th \u2014 the worst example, but not the only \u2014 snaked through a dozen counties, cutting up municipalities and was commonly referred to as looking like \u201cDonald Duck kicking Goofy.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">While U.S. Rep. Patrick Meehan (R-7) already announced he would not seek reelection this year, following a scandal involving a harassment payout to a former staffer, U.S. Rep. Ryan Costello (R-6) already faced a difficult race against likely Democratic challenger Chrissy Houlahan from Devon.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The new district boundaries should be clear by month\u2019s end \u2014 either the legislature will create new maps, or the court will create its own and implement them.
