{"id":29270,"date":"2018-07-30T10:51:46","date_gmt":"2018-07-30T14:51:46","guid":{"rendered":"http:\/\/kennetttimes.com\/?p=29270"},"modified":"2018-07-30T10:51:48","modified_gmt":"2018-07-30T14:51:48","slug":"chesco-attorney-charged-with-defrauding-clients","status":"publish","type":"post","link":"https:\/\/kennetttimes.com\/?p=29270","title":{"rendered":"Chesco attorney charged with defrauding clients"},"content":{"rendered":"<div id=\"attachment_7787\" style=\"width: 250px\" class=\"wp-caption alignright\"><a href=\"http:\/\/kennetttimes.com\/wp-content\/uploads\/2018\/07\/Janis.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-7787\" class=\"size-medium wp-image-7787\" src=\"http:\/\/kennetttimes.com\/wp-content\/uploads\/2018\/07\/Janis-240x300.jpg\" alt=\"\" width=\"240\" height=\"300\" \/><\/a><p id=\"caption-attachment-7787\" class=\"wp-caption-text\">Joshua Janis<\/p><\/div>\n<p>Authorities have a charged a county attorney \u2014 Joshua Janis \u2014 saying he charged numerous clients for work never done or only partially completed.<\/p>\n<p class=\"p1\">Chester County Dist<span class=\"s3\">r<\/span>ict Attorney Tom Hogan announced the arrest of attorney Joshua Janis on <span class=\"s8\">charge<\/span><span class=\"s10\">s<\/span> <span class=\"s9\">tha<\/span><span class=\"s12\">t<\/span> he defrauded over 25 clients, many in divorce cases.<\/p>\n<p>Authorities have identified at least 25 cases and are asking the public to contact them if they also have been alleged victims of Janis.<!--more--><\/p>\n<p class=\"p3\"><span class=\"s3\">Janis, 37, of Downingtown, worked as an associate at county law firm from 2006- <\/span>2013. From 2013 <span class=\"s3\">&#8211; <\/span>20<span class=\"s3\">1<\/span>5, the defendant worked for his own <span class=\"s12\">l<\/span><span class=\"s9\">aw<\/span> firm. He started his own firm in Downingtown but moved around to various other <span class=\"s9\">location<\/span><span class=\"s12\">s <\/span>in Chester <span class=\"s19\">County<\/span><span class=\"s11\">.<\/span><\/p>\n<p class=\"p5\"><span class=\"s22\">&#8220;<\/span>People turn to an attorney when they need help with often stressful personal or business issues,&#8221; Hogan said. &#8220;The defendant betrayed <span class=\"s3\">t<\/span>he trust of his clients, taking their money and often doing no work in <span class=\"s14\">return<\/span><span class=\"s24\">.<\/span><span class=\"s14\">&#8220;<\/span><\/p>\n<p class=\"p7\"><span class=\"s8\">Th<\/span>e <span class=\"s8\">fact<\/span>s <span class=\"s8\">allege<\/span>d <span class=\"s8\">i<\/span>n <span class=\"s8\">th<\/span>e <span class=\"s8\">crimina<\/span>l <span class=\"s8\">com<\/span>p<span class=\"s3\">l<\/span><span class=\"s8\">ain<\/span>t <span class=\"s8\">ar<\/span>e <span class=\"s8\">a<\/span>s <span class=\"s8\">f<\/span><span class=\"s19\">o<\/span><span class=\"s8\">llows<\/span><span class=\"s25\">:<\/span><span class=\"s26\">1<\/span><\/p>\n<p class=\"p9\">Janis had a general law practice, handling family court matters, civil disputes, and criminal cases<span class=\"s22\">.<\/span> During the course of his <span class=\"s9\">practice<\/span><span class=\"s28\">, <\/span>the Office of Disciplinary Counsel of the Supreme Court of Pennsylvania received multiple complaints about him from clients and a judge.<\/p>\n<p class=\"p9\">Those complaints eventually led to the defendant being suspended from the practice of law and triggered a criminal investigation by the Chester County Detectives, the investigative arm of the Chester County District Attorney&#8217;s Office.<\/p>\n<p class=\"p15\">Authorities said an investigation of Janis&#8217; business practices revealed a simple pattern: he would be retained by a client to do work. The client would give the defendant money for the case. Instead of depositing the client&#8217;s money into the trust account required for client&#8217;s money, the defendant would deposit the money into his own account or otherwise take the money. Then the defendant would do no work, or very little, on the case, all the while assuring the client that he was handling the matter. When the client discovered the problem, the client would have to hire another lawyer to address the problem, represent him or herself, or the problem remained unresolved.<\/p>\n<p class=\"p17\">For instance, Andrew Whitmore hired the defendant to represent him in a divorce case. Whitmore reportedly paid the defendant a total of $2,650. The defendant never even entered his appearance in the case to represent Whitmore. Instead, by 2016,\u00a0 Whitmore had to retain a different attorney and had lost $2,650 to the defendant.<\/p>\n<p class=\"p19\">Dawn DiDonato hired the defendant to file a civil cause of action for invasion of privacy. She paid the defendant a retainer of$1,500. Janis allegedly told DiDonato that he filed a civil complaint on her behalf. In fact, the defendant never filed any complaint on DiDonato&#8217;s behalf, investigators said.<\/p>\n<p class=\"p21\">Gary Willman hired the defendant to represent him in a divorce case.\u00a0 Willman paid the defendant $1,500. Janis took the money, deposited it into his own account, but never even filed an entry of appearance in the case on behalf of Willman, authorities said. Willman eventually had to hire another lawyer to handle the case.<\/p>\n<p class=\"p22\">Elizabeth Flower hired Janis to obtain a civil-union divorce for her son Charles, who had married his partner in a civil union in Vermont in 2001. Ms. Flower paid the defendant $1,000. Janis allegedly told Ms. Flower that he had filed the paperwork, but that the case was delayed because the judge had &#8220;something against gay people and that straight people&#8217;s divorces are put first.&#8221; Janis reportedly eventually told Flower that the divorce was final. In fact, the defendant never filed any divorce proceeding. Flower had to hire another attorney.<\/p>\n<p class=\"p24\">In total, over 25 victims have come forward at <span class=\"s31\">this<\/span> <span class=\"s31\">point.<\/span> Janis has been charged with felony theft charges. This case will <span class=\"s31\">be <\/span>consolidated <span class=\"s31\">with an <\/span>earlier criminal case <span class=\"s31\">with <\/span>other victims<span class=\"s34\">. <\/span>The <span class=\"s31\">combined <\/span>losses <span class=\"s31\">suffered <\/span>by <span class=\"s31\">the <\/span>victims in both cases are over <span class=\"s31\">$90,000.<\/span><\/p>\n<p class=\"p25\">&#8220;This is not the first crimina<span class=\"s34\">l<\/span> comp<span class=\"s34\">l<\/span>a<span class=\"s34\">i<\/span>nt filed against the defendant, and I <span class=\"s31\">fear<\/span> it will not be <span class=\"s31\">the<\/span> last,&#8221; Hogan said. &#8220;We are concerned that there are <span class=\"s31\">other <\/span>victims out <span class=\"s31\">there.
